Many gun owners are already familiar with the process of buying a new firearm. They know what to expect, how much time it can take, and where to go for their gun purchases. But, for a first-time gun buyer, the procedures may not be as clear. For example, there has been a lot of misinformation in recent times surrounding firearm purchases--specifically when it comes to background checks. And, if you don't know what to expect, the process may seem impenetrable and potentially overwhelming. But it doesn't have to be. What Is an FFL?

A Federal Firearms License (FFL) is generally necessary for businesses that sell firearms within the United States. This has been a requirement since the Gun Control Act of 1968 was first enacted, which was itself an update to the Federal Firearms Act of 1938. FFL licenses are issued by the Bureau of Alcohol, Tobacco, Firearms, and Explosives with a total of 11 types available. 

Types include pawnbroker in firearms other than destructive devices (Type 2), manufacturer of ammunition for firearms (Type 6), and dealer in destructive devices (Type 9), among others. This means we adhere to the federal regulations and procedures required for lawful gun sales, including background checks.

How Does the Process of Purchasing a Firearm Work?

One of the regulations set in place under the Federal Firearms Act of 1968 includes validating the identity of potential gun buyers prior to the sale. The buyer should bring a valid, up-to-date form of photo identification. You will also need to fill out ATF Form 4473, also known as the Firearms Transaction Record. This information is kept by the FFL-licensed dealer in the event that such records are requested by the ATF. 

After the buyer completes the form, the FFL-licensed dealer uses the National Instant Criminal Background Check System to confirm the buyer's eligibility for the purchase. This process may take three days or longer.

Sometimes an approval can be relatively fast, but other times it can take several days or weeks. The buyer may also be denied for a number of reasons, such as a standing court order, dishonorable discharge from the U.S. Armed Forces, or a history of drug addiction. Conviction for a crime with imprisonment exceeding one year or conviction for a misdemeanor crime of domestic violence can also lead to a denial. 

However, for the majority of gun buyers, these restrictions should not be an issue. Once your purchase is approved, the transaction can be completed. By that point, you can officially consider yourself a firearm owner.
